Article 1 – Details and definitions

Lou Studio is a trade name of the general partnership (VOF) of Maximilian Lammertink and Fay Beeren, located at Kabelweg 22, 1014 BB Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 99749793, VAT number NL869117464B01. In these terms:

Article 2 – Applicability and booking

  1. These terms apply to all quotes, bookings and agreements with Lou Studio. The renter’s own terms and conditions do not apply unless Lou Studio has expressly accepted them in writing.
  2. A booking is concluded as soon as Lou Studio has confirmed it by email or through the booking system.
  3. The renter must be at least 18 years old. A renter booking on behalf of a company declares that they are authorised to enter into the agreement on its behalf.
  4. When booking, the renter states the purpose of the production and the expected number of people present. A maximum of six people are allowed in the studio at the same time, unless Lou Studio gives prior written permission for a larger number.
  5. A quote is valid for 14 days, unless the quote states a different period. Obvious errors in prices, availability or other details do not bind Lou Studio, insofar as permitted by law.

Article 3 – Rates, payment and damage

  1. The applicable rates are stated on the Lou Studio website or in the quote. All rental prices exclude VAT. VAT is charged separately.
  2. The studio is rented for a minimum of two hours. Rent may be charged per two hours, half day or day, depending on the chosen rate. Set-up and break-down time are part of the booked rental period.
  3. The renter pays the full rental price in advance, no later than before the start of the rental period. For bookings made more than seven days in advance, payment must be received no later than seven days before the rental period. For later bookings, payment is due immediately upon booking. Lou Studio may cancel a booking if payment is not made on time, subject to the applicable cancellation terms.
  4. The renter is responsible for damage to the studio, its furnishings and equipment, insofar as this damage can be attributed to the renter or to persons for whom the renter is responsible. Lou Studio may charge the reasonable and demonstrable costs of repair or replacement. This does not apply to normal wear and tear or to damage that was already present at the start of the rental period.
  5. If the renter uses the studio for longer than the booked rental period, Lou Studio charges € 50 per hour for the extra time. For overtime of less than one hour, this is charged pro rata per half hour started. The renter must pay these extra costs, even if there is no following booking. If the overtime causes additional demonstrable costs because a following booking is obstructed, these costs may be charged separately, insofar as permitted by law.
  6. If the renter does not pay on time, Lou Studio may charge statutory interest and any extrajudicial collection costs, provided the applicable statutory conditions are met. Lou Studio may take further steps to collect the outstanding amount, in accordance with applicable laws and regulations.

Article 4 – Cancelling and rescheduling

  1. A booking is for a fixed date and time. The cancellation terms below apply, insofar as permitted by law.
  2. The renter can cancel a booking by email. The date on which Lou Studio receives the cancellation determines the cancellation fee:
    When you cancelCancellation fee
More than 7 days before the booking dateFree of charge
7 days to 48 hours before the booking date50% of the rental price
Less than 48 hours before the booking date, or no-show100% of the rental price
  3. The renter may reschedule a booking once free of charge, provided the request is sent by email no later than 48 hours before the original booking date and the requested new date is available. Rescheduling is final only after confirmation by Lou Studio.
  4. Lou Studio may cancel a booking if the studio is unavailable due to unforeseen circumstances, such as serious damage, technical failures or force majeure. In that case the renter may choose between a full refund of the rent paid or a new booking date. Any statutory rights of the renter remain applicable.

Article 5 – Use of the studio

  1. The renter uses the studio only for photo and video productions and follows the house rules and instructions of Lou Studio. The renter is responsible for the conduct of everyone they bring to the studio.
  2. Without prior written permission from Lou Studio, it is not allowed to smoke (including e-cigarettes), or to use open flames, smoke machines, confetti, glitter, paint, fake blood or water on the floor, or to bring pets.
  3. Backdrop paper that is used up, damaged or soiled during the rental period to the extent that it cannot be reused is charged at € 15 per linear metre, excluding VAT.
  4. The renter returns the studio clean and in its original set-up. If extra cleaning is needed because the studio was not left tidy, Lou Studio may charge € 35 per hour, excluding VAT. Any further costs resulting from damage or soiling may be charged separately.
  5. Using the studio for illegal activities or sexually explicit productions is not permitted. In case of a breach of this provision, Lou Studio may end the rental period immediately. Any refund of the rental price is assessed based on the circumstances and the applicable statutory rules.
  6. The renter is responsible for obtaining all necessary consent from models and other recognisable people to create, use and publish images, insofar as required by law.

Article 6 – Equipment, damage and liability

  1. The renter checks the studio and the equipment on arrival and reports visible defects to Lou Studio as soon as possible. Not reporting a defect immediately does not automatically mean that the defect arose during the rental period.
  2. The financial consequences of damage to the studio, its furnishings and equipment are governed by article 3.4. The other liability provisions of this article remain fully applicable.
  3. Lou Studio is not liable for loss, theft or damage to the property of the renter or their guests, unless the damage results from a circumstance for which Lou Studio is liable by law.
  4. Insofar as permitted by law, Lou Studio is not liable for indirect damage, such as loss of income, missed assignments or consequential damage from not being able to use the studio fully or at all. This limitation does not apply to damage resulting from intent or deliberate recklessness on the part of Lou Studio, or where liability cannot be excluded by law.
  5. Insofar as permitted by law, the liability of Lou Studio is limited to the amount paid out by its liability insurance in the case concerned. If the insurance does not pay out, liability is limited to the rental price of the booking concerned. This limitation does not apply where liability may not be limited by law.
  6. Lou Studio has no control over the safety of equipment brought by the renter; the renter is responsible for it.

Article 7 – Force majeure

  1. Force majeure means any circumstance beyond the reasonable control of Lou Studio that makes the studio fully or partly unavailable or prevents performance of the rental agreement, such as fire, water damage, power failure and serious technical failures.
  2. If Lou Studio cannot make the studio available due to force majeure, Lou Studio contacts the renter as soon as possible. The renter may then choose a new rental date, subject to availability, or a full refund of the rent already paid.
  3. Lou Studio is not obliged to compensate further damage caused by force majeure, insofar as permitted by law. This does not affect any mandatory statutory rights of the renter.
  4. If force majeure arises during the rental period, Lou Studio and the renter will agree on a suitable solution, taking into account the unused part of the rental period and the circumstances of the case.

Article 8 – Images and social media

  1. The renter retains the rights to the images they create, insofar as those rights belong to the renter.
  2. Lou Studio does not publish or use photos, videos or other images of the renter, models or productions on its own website, social media or other promotional channels without prior consent from the rights holder and, where necessary, from recognisable people shown.
  3. Lou Studio may use images of the studio itself for promotional purposes, provided no recognisable people or confidential material are visible, unless consent has been obtained.
  4. The renter may mention Lou Studio as the location on social media, but is not obliged to.

Article 9 – Complaints

Complaints about the rental period can be sent by email to info@loustudio.nl, preferably within seven days after the rental period. Lou Studio aims to respond within fourteen days. This period does not affect the renter’s statutory rights.

Article 10 – Privacy

Lou Studio processes personal data in accordance with the privacy policy on loustudio.nl.

Article 11 – Governing law and final provisions

  1. All agreements with Lou Studio are governed by Dutch law. Disputes are submitted to the court that has jurisdiction by law.
  2. If any provision is invalid, the other provisions remain in force.
  3. Lou Studio may amend these terms. Existing bookings are governed by the terms in force at the time of booking.
